（一）适用对象

1.Theemployerhasthelegalpersonstatusandhastheabilitytocarryouttheworkofemployingforeignexperts.

1.聘请单位具有法人资格，有开展聘请外国专家工作的能力。

2.HaveacleartasktoworkinChina.

2.有明确的来华工作任务。

3.HaveadetailedscheduleforactivitiesinChina.

3.有详细的在华活动日程。

4.TherearesufficientfeestoprotectforeignexpertsfromChina.

4.有充足的费用保障外国专家来华。

5.Thosewhomeettherequirementsofforeignhigh-talents(ClassA)ormeettherequirementsoftheNoticeonFurtherImprovingtheRelevantProceduresforForeignExperts'Short-termVisitinChina(,2015)canapplyfortheinvitationletterofforeignexpertstoChina.

5.符合外国高端人才（A类）或符合《关于进一步完善外国专家短期来华相关办理程序的通知》（外专发〔2015〕176号）文件规定的，可申请外国专家来华邀请函。

（二）办事依据

1.NoticeoftheStateAdministrationofForeignExpertsAffairsonFurtherImprovingtheRelevantProceduresforForeignExpertsinChina(,2015).

1.国家外国专家局《关于进一步完善外国专家短期来华相关办理程序的通知》（外专发〔2015〕176号）。

2.NoticeoftheStateAdministrationofForeignExpertsAffairsontheIssuanceofTheWorkLicenseServiceGuideforForeignersinChina(Interim)(,2017).

2.国家外国专家局关于印发《外国人来华工作许可服务指南（暂行）》的通知（外专发〔2017〕36号）。

(3)Standardsforprovidingmaterials

（三）提供材料标准

1.AllcolororiginalandChinesetranslationsofpapermaterialsshallbeuploadedtotheworkmanagementservicesystemofforeignersinChina.

1.所有纸质材料彩色原件及中文翻译件均须以电子方式上传至外国人来华工作管理服务系统。

2.Non-ChinesecertificationmaterialsshouldbeprovidedinChinesetranslationandstampedwiththeofficialsealoftheemployer(exceptpassportorinternationaltraveldocuments).

2.非中文证明材料均需提供中文翻译件，并加盖用人单位公章（护照或国际旅行证件除外）。

3.Thereisnoneedtosubmitpapermaterialstotheacceptancewindowforverification.

3.无需提交纸质材料到受理窗口核验。

(4)Requiredmaterials

（四）所需材料

1.TheapplicationletterofInvitationforForeignExpertstoChina(includingthebasicinformationoftheapplicant,thereasonforarrival,thetimeofstayinChina,thefeearrangement,thecommitmentoftheauthenticityoftheinvitationbehaviorandtheguaranteeforthepaymentoftheinvitedforeignexpertsinChina),whichshallbestampedwiththeofficialsealofthecompany.

1.《外国专家来华邀请函》申请函（内容应包括申请人基本信息、来华事由、在华停留时间、费用安排和用人单位对邀请行为的真实性作出承诺及对被邀请外国专家在华费用支付等进行担保），需盖单位公章。

2.TheapplicationformofInvitationtoForeignExpertsinChinashallbestampedwiththeofficialsealofthecompany.

2.《外国专家来华邀请函》申请表，需盖单位公章。

3.Foreignexpertpassportorinternationaltraveldocuments.

3.外国专家护照或国际旅行证件。

4.Thecopyoftheshort-termemploymentcontractordispatch(invitation)lettershallbestampedwiththeofficialsealofthecompanyandsignedbythelegalpersonorthepersoninchargeoftheforeignaffairsdepartment.

4.短期聘用合同或派遣（邀请）函复印件，需盖单位公章，法人或外事部门负责人签字。

5.Othercertificationmaterialsdeemednecessarybytheissuingauthority(forexample,relevantcertificationmaterialsshouldbesubmittedforhigh-talents(ClassA)).

5.发证机关认为需要的其他证明材料（例如，符合高端人才（A类）的应提交相关证明材料）。

(5)Mattersneedingattention

（五）注意事项

1.ApplyforFvisawiththeinvitationletterfromforeignexpertstoChina,anddonotneedtoapplyforworkresidencecertificateafterentry.

1.持外国专家来华邀请函申请F字签证，入境后无需办理工作类居留证件。

2.AccordingtothelawsandregulationsofChina,iftheapplicantshallbepre-approvedbythecompetentdepartmentoftheindustryorhavethecorrespondingprofessionalqualificationinChina,theapprovaldocumentsorprofessionalqualificationcertificateofthecompetentdepartmentoftheindustryshallalsobeprovided.

2.我国法律法规规定应由行业主管部门前置审批或具备我国相应准入类职业资格的，还应提供行业主管部门批准文书或职业资格证明。

3.Employersandforeignersshouldensuretheauthenticityofthesubmittedcommitments,andactivelycooperatewiththeexaminationan,theexaminationandapprovalauthoritiesshallhavetherighttocanceladministrativedecisionsaccordingtolaw,andsuspthehandlingofworkpermitsbyemployers,agenciesandforeigners,anddealwiththoseinvolvingviolationsoflawsandregulations.

3.用人单位和外国人应确保提交承诺内容的真实性，并积极配合做好各审批机关约谈及事中事后监管的核查工作。对提供虚假承诺的，审批机关有权依法取消行政决定，并暂缓用人单位、代办机构及外国人办理外国人来华工作许可业务，涉及违法违规的依法处理。

(6)Handlingprocedures

（六）办理程序

1.TheemployerofforeignexpertsshallapplyinthemanagementservicesystemofforeignersinChina.

1.外国专家的聘请单位在外国人来华管理服务系统中提出申请。

2.Thehandlingauthorityshallaccepttheapplicationoftheemployerandinformtheemployeroftheacceptanceresultwithin5workingdays(thedateofsubmittingthematerialsshallnotbecountedwithintheperiod).

2.办理机关对聘请单位的申请进行受理，并在5个工作日（材料提交当日不计算在期间内）内向聘请单位告知受理结果。

3.Aftertheacceptanceinstitutionacceptstheapplicationonline,thedecisioninstitutionshallexamineandmakeadecisionwithin5workingdaysfromthedateofacceptance,andshallnolongersubmitpapermaterialsforverification.

3.受理机构网上受理后，决定机构应当自受理之日起5个工作日内进行审查并作出决定，不再提交纸质材料核验。

4.Ifthedecisionismade,thehandlingauthorityshallissuetheInvitationLetterfromForeignExpertstoChina.

4.决定通过的，由办理机关签发《外国专家来华邀请函》。

5.ForeignexpertsshallapplytotheChinesevisaauthoritiesforanFvisaofnomorethan90days(inclusive)withtheInvitationLetterofForeignExpertstoChinaandrelevantmaterials.

5.外国专家持《外国专家来华邀请函》及相关材料，向我驻外签证机关申请来华停留时间不超过90天（含）的F字签证。

(7)Timelimitforexaminationandapproval

（七）审批期限

Acceptanceperiod:5workingdays(subjecttothecompletematerialssubmittedbytheemployeronline).

受理期限：5个工作日（以用人单位网上提交完整并符合要求的材料为准）。

Theperiodofreviewanddecision:5workingdays(startingfromthedateofacceptance).

审查决定期限：5个工作日（以受理之日起开始计算）。

Iftheperiodneedstobeextedunderspecialcircumstances,thelicensingacceptinginstitutionorthedecisioninstitutionwilldealwithitasappropriate.

遇特殊情况需延长期限的，许可受理机构或决定机构将酌情处理。
